GENERAL CONDITIONS OF SALE

These General Terms and Conditions of Sale and Online Service Provision (hereinafter referred to as the "General Terms and Conditions of Sale and Online Service Provision") shall apply.General Terms and Conditions of Online Sale or GTCS") apply without restriction or reservation to:

  • The transactions carried out between a Client and GLOBAL FAP for the reservation and/or purchase of products and services (hereinafter referred to as the ".Products" y "Provision of services") online via the websitehttps://globalfap.com/hereinafter referred to as the "Website"when the place of delivery of the Products or performance of the Services requested is throughout the Spanish territory, as well as in countries of the European Union and third countries.

GLOBAL FAP, a company with registered office at Calle Tren de los Panaderos, Edificio Puerta del Príncipe, 41005, Seville (Spain), holder of Tax Identification Number B90432915 and registered in the Companies Register of Seville, Folio 40, Volume 6712, Section 8, Page SE121729, is hereinafter referred to as ".The Seller".

Please read these Terms carefully before using this website; by using this website or placing an order through this website, you agree to be bound by these Terms. If you do not agree to all of the Terms, you should not use this website.

The validation of the order by the customer implies unreserved acceptance of these general terms and conditions of sale. In the event of modification, these General Terms and Conditions of Sale shall be binding for all purchases made after their publication on the website.

Unless proven otherwise, the data recorded by GLOBAL FAP on the transactions made through the website constitute proof of the same.

ARTICLE 1: SUBJECT MATTER AND SCOPE

These terms and conditions shall apply to the exclusion of any other terms and conditions, without prejudice to the provisions of the legislation in force.

Before registering and opening an account or placing an order, please note the following:

  • The User must be of legal age in accordance with Spanish law and have full legal capacity to contract;
  • [The range of Products and Services proposed online does not include all products and services marketed by GLOBAL FAP];
  • The range of Products and Services sold online is reserved for Customers (natural persons and legal entities).

The Customer is informed of the importance and necessity of providing all the requested information about his vehicle, in particular the registration number, the vehicle's engine, the mileage, the precise size of the tyres, its speed rating, the conditions of use of the vehicle, etc....

It is the Customer's responsibility to check that the Product/Service selected is compatible with their vehicle.

The Seller will not be responsible for any damage that may occur in those products that require installation and which the Customer is responsible for himself outside GLOBAL FAP centres.

ARTICLE 2: HOW TO PLACE AN ORDER ON THE WEBSITE

2.1.- SELECTION OF PRODUCTS AND SERVICES. - ACCOUNT CREATION

The Customer who wishes to order a Product and confirm an order through the website shall:

  • Select the Products and/or Services appropriate to your needs after consulting the descriptive sheet, if applicable, by clicking on the corresponding icon, 
  • Select the desired quantity so that they can be placed in the "basket", with no commitment to buy,
  • Indicate where the Customer wishes the Products to be delivered and/or the ordered Services to be performed (indicate the address to which the Customer wishes the order to be delivered),
  • Complete the identification data, validate the order and proceed to full payment.

The Customer will be taken to a page where he/she will be asked to fill in the necessary information to open an account if it is the first order, or to identify him/herself if he/she already has an account.

The information required to open an account is: name, surname, telephone number, postal address, e-mail address which will be the username, and password.

After filling in the form or logging in as a registered customer, the Customer can immediately return to his/her basket, delete or add products.

At this stage, all order data is collected: products, quantity, unit price, associated services, possible discounts and total order amount. You will be asked for any additional data necessary to complete your order and to invoice you.

The customer will select the chosen payment method via the website. After having clicked on the acceptance box of the present general terms and conditions of sale, and having clicked on "confirm", the customer will be directed to the payment platform. The Customer acknowledges having a payment obligation.

Once the customer has validated his basket and his payment method, the order cannot be modified or cancelled, unless GLOBAL FAP decides to do so unilaterally. The customer will receive an email confirming the content of his order.

 

2.2.- TARIFFS

The prices of the Products and Services are communicated according to the rates in force on the website at the time of registration of the order by the Seller.

Prices are expressed in euros, excluding taxes and duties.

The transport costs of the Product will be indicated before making the payment so that the Customer can choose the option of "shipping on behalf of GLOBAL FAP" or "on behalf of the Customer" (the Customer can send the collection). In any case, the cost of transport will be charged to the Customer in the final price.

ARTICLE 3.- PAYMENT CONDITIONS

 

The Customer shall have the option of paying for the Products and Services ordered on the Website either through the Website or by bank transfer.

When selecting payment via the website, the Customer will be taken to a secure payment platform where the Customer will be asked for their bank card details. The Seller has no access to the Customer's bank details, which are protected by SSL (Secure Socket Layer) protocol. Bank details will not be processed or kept by the Vendor's systems at any time. Payment via the dedicated platform integrated into the website is debited from the account at the time of order confirmation.

GLOBAL FAP reserves the right to claim payment and collection costs from the customer in the event of a problem with the collection.

The selected GLOBAL FAP Centre will be the one to issue the invoice corresponding to the purchase of Products and Services. The sale will be considered final with the delivery of the Product and/or the performance of the Service, and when the price has been received by the Seller in full.

ARTICLE 4.- DELIVERY, PERFORMANCE OF THE SERVICE AND INVOICING

4.1 DELIVERY OF PRODUCTS AND PROVISION OF SERVICES

Upon completion of the order, the Customer immediately receives a confirmation of the order by e-mail containing the Product(s) and/or Service(s) ordered, the total price of the Product(s) and the chosen method of payment.

The Seller shall deliver the invoice to the Customer at the time of delivery of the Products and/or performance of the Service.

4.2 DELIVERY TIME OF THE ORDER

Subject to availability, the delivery of the Products and the performance of the Services shall take place at the address selected by the Customer in his order, which appears in the order confirmation email.

In case of temporary or permanent unavailability of a product ordered due to a stock shortage, GLOBAL FAP will contact the customer as soon as possible to offer the possibility to cancel the order, in which case the customer will be refunded the full amount paid within 7 days of cancellation.

The delivery time of the product or performance of the Services will depend on the delivery address and transport conditions in each country.

Delay in delivery of the Products or performance of the Services shall in no event give rise to any compensation.

ARTICLE 5.- RESERVATION OF OWNERSHIP AND TRANSFER OF RISKS

The Seller retains ownership of the Products ordered or sold until full payment of their price. On the other hand, the responsibility for loss and deterioration of the Product is the customer's from the time of delivery and receipt of the Product by the Customer.

 

ARTICLE 6.- RETURN POLICY

 

GLOBAL FAP will not accept the return of the product or the withdrawal of the purchase once the payment has been made.

ARTICLE 7: GUARANTEES FOR PRODUCTS AND SERVICES

The guarantee for the sale of defective products is two (2) years, in accordance with the conditions set out in Royal Legislative Decree 1/2007 which approves the Consolidated Text of the Law for the Defence of Consumers and Users. 

In order for this guarantee to be valid, the product must have a defect of origin and the customer must keep the purchase invoice for the product. The warranty only covers defects of origin, in accordance with current legislation. In other words, the deterioration of the product due to normal use is excluded from the guarantee, as well as breakage or wear and tear due to improper use, which in any case will be the responsibility of the Client.  

The customer must contact the Seller in the event that he/she detects such a defect of origin in the product. It shall be presumed to be of origin if it manifests itself within the first six months of purchase, and in the remaining time up to two (2) years it shall be the customer's responsibility to prove the existence of such defect and that it existed from the origin of the purchase.

In order to deal with these questions, the Seller provides the customer with the Customer Service Department, which can be contacted by telephone or by e-mail.info@globalfap.com.

ARTICLE 8: PERSONAL DATA

In accordance with current legislation on protection of personal data, GLOBAL FAP informs users that the data you provide through any of our Web Services (personal data, addresses, vehicle, purchases and payment methods, as well as any other) will be treated by GLOBAL FAP as responsible for treatment, with registered office in Tren de los Panaderos street, Puerta del Príncipe Building, 41005, Seville (Spain). These data will be used for the formalization of your purchase, the processing of your order, appointment scheduling, quality studies and satisfaction surveys about your shopping experience, for the fulfilment of tax obligations and for sending, by any means, including email or equivalent means, advertising or specific commercial communications that may be of interest to you about GLOBAL FAP products and services.

The legal basis that legitimises us to process your data is for the fulfilment of a contract, consisting of the web purchase of a specific product or service.

ARTICLE 9: INDUSTRIAL AND INTELLECTUAL PROPERTY

The content of this website is property of GLOBAL FAP and is protected by Spanish and international legislation regarding industrial and intellectual property.

Any reproduction in whole or in part is strictly prohibited and may constitute a civil and criminal offence.

GLOBAL FAP owns all intellectual property rights on the studies, designs, models, prototypes, etc. made to provide the service to the client. The client is forbidden to reproduce and exploit the mentioned studies, designs, models and prototypes without prior, express and written authorisation from GLOBAL FAP, who may make such authorisation conditional on obtaining a financial compensation. 

ARTICLE 10: COMPLAINT AND DISPUTE FORMS

GLOBAL FAP is adhered to the System of Electronic Complaints and Claims Sheets of the Junta de Andalucía (introduce LINK), which allows, through the use of a Digital Certificate, to submit complaints and claims sheets electronically with the same functionalities as the paper complaints and claims sheets.

ARTICLE 11: APPLICABLE LAW

The legislation applicable to the information and Content of this Website shall be the Spanish Law in force. Any controversy or conflict that may arise as a result of the use of this Website or the Legal Notice shall be resolved in the competent Courts and Tribunals of the city of Seville and, in the case of a User acting as a consumer, the court of the domicile corresponding to the User/consumer.

The User, if acting as a consumer, may also submit any dispute arising out of or in connection with these Terms of Use to an alternative dispute resolution ("ADR") procedure.
